What does OSHA require for porta potties on a construction site?
OSHA 29 CFR 1926.51(c) requires toilets at every construction jobsite, scaled to the number of workers. Table D-1 sets 1 toilet for 20 or fewer workers, 1 seat and 1 urinal per 40 workers for 20 or more, and 1 seat and 1 urinal per 50 workers for 200 or more. Mobile crews need nearby toilets or transport to them.
| Number of employees | Minimum facilities (Table D-1) |
|---|---|
| 20 or fewer | 1 |
| 20 or more | 1 toilet seat and 1 urinal per 40 workers |
| 200 or more | 1 toilet seat and 1 urinal per 50 workers |

Does OSHA require handwashing at a jobsite?
Yes. OSHA 29 CFR 1926.51(f) requires washing facilities when workers handle paint, coatings, herbicides, insecticides or other harmful contaminants, located near the work. The washing facilities must be kept sanitary and stocked. Many general sites use hand sanitizer in the toilet; we recommend a handwashing station where crews eat.

What are the OSHA rules for farms and agricultural work?
OSHA 29 CFR 1928.110 requires 1 toilet and 1 handwashing facility for every 20 field workers, within a quarter-mile walk of each worker's work location. The rule applies to agricultural employers with 11 or more workers doing hand labor in the field on a given day. Water must be potable for drinking and handwashing.

What is the legal minimum vs. what we recommend?
The OSHA table is the legal floor. We recommend more when crews work long shifts or in heat. Our advice: add 1 unit or a second weekly service when crews work over 40 hours a week, when 20 or more workers share one unit, and in July and August when 100°F days speed up odor.
| Situation | OSHA minimum | Our recommendation |
|---|---|---|
| 15 workers, 40 hrs/week | 1 unit | 1 unit, weekly service |
| 22 workers, 50 hrs/week | 1 unit | 2 units or twice-weekly service |
| 45 workers, 40 hrs/week | 2 units | 2 units + 1 handwashing station |
| Summer, 30 workers | 1 unit | 2 units, shaded |
Questions renters ask us
Does a porta potty with a urinal count as two facilities?
A standard unit has 1 toilet seat and 1 urinal, which matches the "1 seat and 1 urinal" pairing in Table D-1.
Are there rules for distance to the toilet?
The construction standard requires toilets to be available; the farm standard sets a quarter-mile walk. We place units close to where crews work.
Does OSHA require separate toilets for men and women on a jobsite?
No when units are single-occupancy with locking doors: 1926.51 allows single-occupancy units with locking doors to be used by either sex.
Who is responsible, the GC or the subcontractor?
The employer of the workers is responsible under OSHA. Contracts often assign it to the GC. Check your contract.
